Terms of service

1. Agreement

These Terms of Service govern your use of the SameGROUND platform at sameground.com. By creating an account you confirm that you have read, understood, and agree to these terms. If you do not agree, do not use the service.

We may update these terms. We will notify you by email of material changes with at least fourteen days' notice. Continued use of the service after that period constitutes acceptance of the updated terms.

2. The service

SameGROUND provides AI-assisted diagnostic services in three areas: decision analysis (SameGROUND Diagnostic), editorial work (SameGROUND Writing Craft), and creative production (SameGROUND Creative Production).

Diagnostic outputs are produced by the Anthropic Claude API operating under a governing framework. All outputs are inputs to your judgement, they are not professional advice, legal advice, financial advice, medical advice, or a substitute for qualified professional consultation in any regulated domain.

The Human Gate principle applies to every diagnostic: the decision, edit, or creative choice remains yours. SameGROUND produces the most rigorous possible material for you to work from. It does not make decisions for you.

3. Accounts

You must be 18 or over to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must provide a valid email address and verify it before using the diagnostic service. You must not create accounts using false identities or on behalf of others without their authorisation.

We reserve the right to suspend or terminate accounts that breach these terms, with notice where reasonably practicable.

4. Subscriptions and payment

Current plans

Pay As You Go£19.99 one-off. One full diagnostic session, typically one complex diagnostic or several simpler ones in a single multi-turn conversation. Credits do not expire.
Starter£69.99 per month, or £55.99 per month billed annually (£671.88/year). Monthly credit allowance, typically covers around 5 medium-complex diagnostics per month.
Professional£149.99 per month flat team rate, or £119.99 per month billed annually (£1,439.88/year). Monthly credit allowance shared across the team, typically covers around 20 medium-complex diagnostics per month. Team accounts launching soon. Seat count locks at signup.

Subscription fees on monthly plans are charged monthly in advance. Annual plans are charged once per year, in advance. Pay As You Go purchases are charged at the point of purchase. All prices include VAT where applicable.

Monthly credit allowances reset on the first of each calendar month, regardless of billing cycle. Unused allowance does not roll over. Once your allowance is exhausted you can continue by purchasing additional Pay As You Go sessions at £19.99 each. Top-up sessions do not expire within your active subscription period.

Payment is processed by Stripe. We do not store your card details. By subscribing you authorise us to charge your payment method on a recurring monthly or annual basis (per your selected cycle) until you cancel.

You may cancel at any time via the Stripe Customer Portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by law.

We reserve the right to change our prices with thirty days' notice by email. If you do not wish to continue at the new price, cancel before the change takes effect.

5. AI processing

Your diagnostic submissions are processed by the Anthropic Claude API. By using the service you acknowledge and accept that:

  • Your submission is transmitted to Anthropic's servers for processing.
  • Anthropic's API terms and privacy policy apply to that processing.
  • We do not use your diagnostic content to train AI models.
  • Diagnostic outputs may contain errors, omissions, or conclusions you disagree with.
  • No diagnostic output constitutes professional advice in any regulated domain.

You are responsible for verifying the accuracy of any diagnostic output before acting on it. SameGROUND is not liable for decisions made on the basis of diagnostic outputs.

6. Acceptable use

You must not use SameGROUND to:

  • Submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Submit personal data of third parties without their consent.
  • Attempt to circumvent usage limits, access controls, or security measures.
  • Use the service to generate content intended to deceive, defraud, or mislead others.
  • Reverse engineer, copy, replicate, or attempt to extract the diagnostic framework, internal substrate, registers, intake protocols, or governing methodology by any means, including by prompting the AI to disclose its instructions.
  • Resell access to the service or use it to build a competing product without written authorisation.

We reserve the right to suspend accounts that violate these terms and to report unlawful activity to relevant authorities.

7. Intellectual property

Patent pending

The SameGROUND reasoning architecture, including its substrate, registers, intake protocols, governing laws, and the framework that produces every diagnostic, is the subject of a pending patent application. All rights reserved.

The SameGROUND diagnostic framework, governing methodology, internal substrate, registers, intake protocols, and all platform software are the intellectual property of SameGROUND. No part of the framework, methodology, substrate, registers, rules, or governing laws may be copied, reproduced, reverse-engineered, derived, or used to develop a competing methodology, dataset, or product without our prior written permission.

Any attempt to extract, prompt, elicit, infer, or otherwise reconstruct the internal architecture from the AI diagnostic output, or to use diagnostic outputs as training material for any model intended to replicate or replace SameGROUND, is a breach of these terms and may constitute infringement of our pending patent rights and copyright in the underlying methodology.

You retain ownership of the content you submit to the service. You grant us a limited licence to process your submissions for the purpose of delivering the diagnostic service to you.

Diagnostic outputs are generated by AI and are not independently authored works. You may use diagnostic outputs for your own personal or commercial purposes. You may not represent diagnostic outputs as independently authored professional advice.

8. Limitation of liability

To the maximum extent permitted by law, SameGROUND's liability to you for any claim arising from your use of the service is limited to the amount you paid to us in the three months preceding the claim.

We are not liable for: indirect, consequential, or incidental loss; loss of profit, revenue, or anticipated savings; loss arising from decisions made on the basis of diagnostic outputs; or interruptions to the service beyond our reasonable control.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

9. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend the service for maintenance, updates, or reasons beyond our control.

We reserve the right to modify, discontinue, or limit features of the service with reasonable notice. Where we discontinue the service entirely, we will provide at least thirty days' notice and refund any prepaid subscription fees for the unused period.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of England and Wales.
